Filing a DMCA Takedown Notice

The Digital Millennium Copyright Act (DMCA) established a process for copyright owners to report alleged infringements. This notice helps us investigate and act on your claim.

Your DMCA Takedown Notice must include the following essential information:

  • Your contact information: full name, address, telephone number, and email address.
  • A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.

Counter-Notification Process

If material you posted on davidgarda.org has been removed or disabled due to a copyright infringement claim, you may file a counter-notification. You can do this if you believe the material was removed by mistake or misidentification. Filing a counter-notification initiates a specific legal process.

Your counter-notification must be a written communication and include the following:

  • Your physical or electronic signature.
  • Identification of the material that has been removed or to which access has been disabled. Provide the location where the material appeared before it was removed.
  • A statement under penalty of perjury that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification.
  • Your name, address, and telephone number.
  • A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which David Garda may be found. You must also accept service of process from the person who provided the original DMCA notification.

Repeat Infringer Policy

David Garda will terminate the accounts of users who are repeat copyright infringers. This policy applies to individuals who repeatedly upload or post infringing content on our site. This includes articles, images, or other media related to home decor and design tips. We reserve the right to remove any content and disable any account that violates this policy.
